Ticket Sales and Returns Policy

Currency and Goods and Services Tax

The prices stated on our website are all in New Zealand Dollars and include Goods and Services Tax.

No Refunds

The Trust is a charitable trust registered with the Charities Commission (registration number CC56478).  Being for charitable purposes the Trust has, so far as is permissible under both the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, a no refund policy.  This applies in respect of any request you might make for reimbursement prior to or on the Wine Auction, Event Day or following the Event Day should the Wine Auction have been cancelled or postponed or you were unable to attend for some reason.

If the Trust does agree to consider a request for reimbursement it will be in the sole discretion of the Trust as to whether or not any reimbursement is paid to you and the manner in which payment is made.

Refunds, exchanges and replacements

  1. The purchaser understands and agrees that the event may have to be cancelled if natural disaster, fire, flood, disease, government restrictions or other similar major incident beyond the committee’s control makes it impossible for event to continue. The committee will decide whether a postponement or cancellation is applicable.  In the case of a postponement the retention of ticket payments will be held until a new date is set, if a cancellation is decided a refund will be offered for the cost of your ticket, less $20 per transaction to cover administration costs.  Proof of purchase may be required for any refund. To the fullest extent permitted by law neither HBWACT nor the Seller will be liable for any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an event, including any travel or accommodation expenses.
  2. HBWACT will only replace lost, stolen, damaged or destroyed tickets if the authenticity of the ticket can be verified, including proof of purchase, and if you give reasonable notice before the event. HBWACT may charge a reasonable fee for the replacement of tickets.

Variations to performances or events

The Seller reserves the right to add, withdraw, reschedule or substitute artists and/or vary advertised programs, prices, venues and audience capacity.

Conditions of Entry

  1. Admission to an event is subject to the Seller’s Terms. In particular, the following form part of the Seller’s terms unless otherwise specified:
  2. You must be 18 years of age or older.
  3. You may be denied entry into, or removed from, an event where the Seller has reasonable grounds to do so, including if you breach these Terms and Conditions or the Seller’s Terms, or you are intoxicated, under the influence of illicit drugs, inappropriately attired or adversely affecting the enjoyment of the event by others.
  4. On purchasing your ticket, you and any relevant ticket holder, agrees to comply with all NZ Government requirements related to COVID-19. The Venue and Promoter may have additional COVID-19 requirements as a condition of entry. You should make yourself familiar with those requirements prior to purchasing your ticket. If you fail to comply with these requirements, you may be refused entry or have your ticket cancelled without further notice to you, without any liability or refund to you, unless required by applicable law.

Authenticity and validity of tickets

Entry to an event may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from HBWACT or other authorised points of sale.

Resale of Tickets & Scalping

Tickets may not, without the prior written consent of HBWACT and the Seller, be resold or offered for resale at a premium (including via on-line auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the ticket holder may be refused admission. HBWACT and/or the Seller will take all reasonable steps to notify you of HBWACT’s intention to cancel the ticket or render it invalid within a reasonable time before cancelling it or rendering it invalid.

SCALPING WARNING: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.

Ticket Collection

  1. All tickets are available for download when purchased from the Hawke’s Bay Wine Auction “HBWA” website and will also be emailed to the email address you specify when purchasing your ticket.
  2. As a sponsor you may have your ticket delivered or available for collection from a point provided by the HBWACT.

Limitations on Number of Tickets Purchased

When purchasing tickets for a particular event you may be limited to a specified number of tickets. If you exceed the stated ticket limit, you may have any or all of your orders and tickets cancelled without notice by HBWACT at its discretion. This includes orders associated with the same name, e-mail address, billing address, credit card number or other information. Ticket limits apply to ensure fair access to tickets for fans, and as a measure to minimise ticket scalping.

Errors

While HBWACT takes all reasonable care to ensure that tickets are correctly priced and only available for sale when intended, sometimes errors may occur. HBWACT may cancel an order made as a result of any such error, although in the case of a pricing error HBWACT will endeavour to contact you to give you the option of purchasing the ticket at the correct price.

HBWACT Online Terms of Use and Privacy Policy

The Website Terms of Use and the HBWACT New Zealand Privacy Policy are incorporated into these Terms and Conditions and apply to all sales through this Site.

General

The term “including” when used in these Terms and Conditions is not a term of limitation.

Ticket Sales and Returns Policy

All purchases in addition to ticket sales made on the Hawkes Bay Wine Auction Website or during the auction events (operated by the Hawke’s Bay Wine Auction Charitable Trust) are final and no refunds shall be given – this includes all purchases from the Hawke’s Bay Wine Auction Charitable Trust’.
